The court order, issued by District Judge Gunjan Gupta on July 19, stated, “Issue summons of the suit and notice of the application under Order 39 Rule 1 and 2 CPC to the defendants, subject to steps by all modes i.e. PF & RC/Speed Post/ Approved Courier including electronic mode for 06.08.2024.”
Nakhua’s complaint asserts that Rathee, along with Google LLC and X Corp (formerly Twitter), released a video on July 7 titled “My Reply to Godi Youtubers | Elvish Yadav | Dhruv Rathee,” in which Nakhua was unjustly labeled as part of a violent troll group, damaging his reputation without any valid reason.
In his lawsuit, Nakhua stated, “This video represents a calculated attempt to tarnish the Plaintiff’s integrity and reputation by making unfounded and malicious allegations.” He claimed that Rathee’s defamatory statements have caused significant and irreversible harm to his personal and professional life.
Additionally, Nakhua accused Rathee of habitual defamation, issuing online threats, and undermining other YouTubers’ careers by leveraging his audience.
Consequently, Nakhua seeks a permanent injunction to prevent Rathee from posting, tweeting, publishing, or sharing any defamatory content about him or the BJP on any platform. He also requested damages amounting to ₹20,00,000 for the defamation caused.
